    For children who started care BEFORE Royal Assent (Dec 4th, 2014), compliance doesn't start until Jan 2016. For any children who were brought in after Royal Assent (after Dec 4th, 2014) compliance is sooner. NOW, this is where some of the confusion lies. There have been mixed messages and none of us is a stranger to it. First, we thought compliance was immediate for children starting care after Dec 4th. However, it now seems that it's after Proclamation (sometime in the Fall - they project - but who knows). It seems to us that even the Ministry doesn't really know what's going on. Like I said, it's a mess. Either way, kids coming into care after Dec 4th are at risk of being in non-compliance either now or after proclamation....when ever that is. We were under the impression that Royal Assent was to be in the summer. We were all shocked when it was fast tracked 2 weeks after the bill was passed....until we saw the Auditor General's report, which explained it. They HAD to push it through quickly as the AGR showed the licensed sector to have a vastly higher injury, serious occurrence and death rate than the unregulated sector. One could argue that more injuries and occurrences aren't reported in the unregulated sector, which is fair enough. BUT, it's pretty hard to cover up the death of a child. Unregulated (78% of the market) had 6 deaths in total, with only 1 being ruled accidental and in the care of a provider in compliance (legal vs illegal). The licensed sector (22% of the market) had 6 deaths as well....a much, much higher incidence of death in childcare. When we saw that, we knew, beyond a doubt, why this bill was pushed through every stage quickly. It had to be or the public would have torn it to shreds.

    There is still a lot on the table that we're working on right now. We are seeking legal counsel regarding the constitutionality of Bill 10 and how it came about. There is talk from Lisa of having the bill repealed should she be elected as head of PCs and should PCs win the election. I'm not sure how that works and am waiting to hear back on that. I'm having my event this week which is the beginning of pulling the sectors together. ADCO (Association of Daycare Operators of Ontario), Montessori schools and ICPs are all unhappy with the bill. This is why we're making efforts to pull all of us together....strength in numbers. We all have different reasons for wanting the bill scrapped or amended. But the fact remains that we all want it and there are a LOT of us! There are a couple other things on the table, but won't go into that just yet.

    Any providers or parents who are being adversely affected by BILL 10 can send their stories to Karen at khsw@outlook.com to be forwarded to the Ombudsman. He is collecting this information for 3 months to see just how Ontario will be impacted by this flawed Bill 10.
