Your 4 year old will count in your numbers. Unless I'm mistaken, I believe your own 8 & 9 yr olds do not count in your numbers. So you have 4 spaces left. The age of a child, defined in the bill, is anyone under 13 years of age, so the over 10s, if they're still under 13, will count. That brings you down to 2 spaces. It sounds to me like you'll have to let some people go. Also, be aware that Proclamation is scheduled for August 31, 2015. Any children brought in AFTER December 4th, 2014, will NOT be grandfathered to Jan 2016. They will need to be compliant by Proclamation. This is a bit of a unique situation and I'm not 100% sure if you can even have over 5 under 13 with grandfathering. Typically, we've discussed this surrounding the 2 under 2 and counting your own children. I do understand that your own kids don't count until Jan.
