I was too. I think it's a bit of a grey area but I do think there's a difference between holidays and set closures every year.
I think it really is up to the provider and what her market will allow.

I not reading it that teachers are choosing not to come. I reading this post as the provider has opted not to be open year round. The provider is choosing not to be available over summer, over march break, over christmas. She is closed so even if teacher wanted to come, they cannot.
This is different to running a day care which is open all year round and a teacher deciding to come and pay for days registered vs used. This is specifically a day care whose availability mirrors the school year and since she not open the weeks over Christmas and New Year, she not available and not get stat leave.
It interesting that not perusing Canada Day or any other stat day in her province over summer when she closed.

Sandylynn - you not understand. No, not same as a stat falling when you on vacation - you pulled that from nowhere.
You are mixing up two entirely different questions on two entirely different threads.
We are not employees. Labour standards do not apply to us. We don't have the protection of min wage and all those regs and rules. The thread you referred to, should you go back and read it again, was about a parent who said you must work the days before and after a stat to get paid for those. This would be accurate if you were an employee but you are not. However, my reply said that if a parent wanted to apply labour standards and view you as an employee, they should be aware that ALL labour standards would apply inc min wage.
Employee = labour standards. Self-employed = no labour standards.
Employee = must work both sides of stat to be paid. Self-employed = paid as per contract
Employee = min wage. Self-employed = no such luck
BUT none of that is anything to do with the question of this thread.
This particular provider mirrors the school board calender. She isn't available all of Summer and her contracts said she doesn't get paid for it. So, she doesn't get to apply a fee for Canada Day which is smack bang in middle of period her service not available and where no fees are due. Her business is totally closed.
Likewise, March Break and Christmas Break, her business is totally closed. She not available. And therefore, because she closed and because she not charging over Christmas, she not entitled to get stat days either.
Sure, she can try and charge but far from her "being screwed" I think she would be screwing parents. She is closed. She has opted not to work or be available. Her contract is specific, no pay for when she closes down her business. So that means stat days too.

I get that you want to have paid stats but you will be operating very differently than most home daycares. Because of how often you close throughout the year, it doesn't seem to be a huge issue for you financially therefore asking for Xmas stat pay would come off as a bit petty if I was in a potential clients shoes. I think the only way for you to get Xmas stats at all is to open for at least part of the break.

I agree with Suzie. She is not operating during summer, spring break or Christmas break therefore paid stats should not apply to those periods of time IMO.
Personally I would remain open Christmas and spring break. You would get paid for the stats and more than likely have minimal kids during that time, if any at all, and you would be paid full rate. Unless of corse there is a specific reason you need to close for those 2 breaks.

yes this was two different threads.....and again....I was NOT refering to any stat holidays during the summer months....if my last post was even read...I take the same 2 weeks every year...I am NOT available during those same two weeks every year but everyone on here seems to think I am entitled to the stat holiday which falls in the middle of my two weeks that I AM NOT AVAILABLE...if I took the summer off....but worked straight from sept til june....teachers take Christmas and march break off....damn right I want the stats paid.....during those breaks

I have teachers kids, all expect my newest child. The mom has a very flexible schedule, so I'm able to fit her in when my youngest is in preschool. So in a way, she'll be following the school calendar as well.
I technically stay open for Christmas and spring break. I rarely have anyone say they plan to come, even though I encourage them to go out and do their Christmas shopping, etc. If I get kids, it's usually only one or two, for a short day. Anyways, they pay me for stats. If I wasn't open, they would not pay for the stats.

I think what some of us are saying though is that this is a completely different model for a home daycare (following the school calendar) and as such I think it should have a different set of "rules" when it comes to stats. I think it just "sits" better that she not charge at all if she isn't planning on being open at all. I think it's different for the rest of us who only take 2-3-4-5 etc weeks off per year. If I take a week off at Xmas I still charge for the stats. I find that taking the whole summer, plus March break plus two whole weeks at Xmas and then asking for stat pay during those times is petty. If you can allow yourself to take 10-12 weeks or whatever it is per year, how much are 2-3 stat days really gonna matter?
