Vent- Abuse by dc mom

So the continuing saga of termination of DCB that was making my life miserable...I gave notice and Mom pulled him, saying via text she wouldn't send him where he wasn't wanted. Well as per contract she also mentioned that I would be paid the last 2 weeks and surprise surprise Friday (pay day) comes and goes with no pay. I really hate having to track down my pay. I may just go file in small claims court. What would you do. She has a real hate on for me obviously. I just wish she would remember all the rides I gave her child home, or the nights I worked late on her behalf. The breaks I gave her when I had to close my DC cause I knew she didn't get paid. No more Mrs. nice guy ever again. Sometimes I just want to quit

I would phone her and ask when she planned on stopping in with payment. If she says she isn't going to be paying you then I would tell her you plan on filing a Small Claim as per your contract. Also mention you have a late payment fee that is increasing as the days go on (if you have this in your contract - if you don't I would implement one immediately for all future families). Good luck.

I agree with Mickyc....phone her up and ask when she is planning on stopping by or would she prefer you come to her house? If she says no to either choice, let her know that you will have to proceed with a small claims file.

She probably won't take your call so leave a polite, business toned message stating her account is overdue and $$$ dollars are owed. If you don't receive the funds by xxxx date, then you will file your claim against her with small claims or you could send the amount owing to collections. I would also send her a registered letter to this effect. Yes, it will cost you money (which you can charge back to her/ or use as a deduction) but it will let her know that when push comes to shove Mrs. Nice guy turns into Mrs. Tough guy.:)

Do not go to her house to get the money or she will use it against you as harassment. All payments need to happen at your place of business - your house.

If I were in this position I would probably look into collections agencies before small claim. If someone threatened me with small claims I may ignore it as I would think the process would be too much of a pain for someone to actually follow through with. The gain would be less then the expenses to file. (time off work etc.) If someone threatened me with collections, that would hurt my credit rating and for that I may react differently. It seems more realistic for someone to put me through collections then spend a whole lot of time on small calims court.

Yep, I'm with apples and bananas on this one. I'd be inclined to ignore a legal threat. Who's really going to bother if it's going to cost them more in the long run, and possibly get them in hot water with remaining clients. Straight to collections would be my choice of action.

I agree with apples and playfelt ..... Do not go to her house and if you are leaving a message asking when she will be coming by to make payment I would not threaten collections at that time..... It kinda gets people's back up and actually I wouldn't mention it at all. I would wait till she either says she's not paying you or just ignores you and then just file with collections she will find out soon enough. When speaking with her or leaving a message you could offer to have her pay by emt ... That way she doesn't have to come to your home again.

Exactly this I never tell people I am taking them to collections I let the agency deal w/ all parts of the collection process.

I texted her today (cause I don't think she'd answer my call) and said just a reminder payday was Friday. So I got a big song and dance about how she had to pay the new daycare 2 weeks in advance and that she lost time at work, blah blah blah. I replied that her pulling him was her decision, I would have kept him the 2 weeks, Seriously this is not my problem. I noticed on Facebook she could afford to go to the Brad Paisley concert! I am going to look into collection agencies. I am so tired of being nice. From now on I am taking a 2 wk deposit for the last 2 weeks and will never bend over backwards for any family again.
